JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-06-2016 Heard learned counsel for the petitioner, learned A.P.P. representing the State and learned counsel for the informant. The petitioner seeks bail in connection with Sakatpur P.S. Case No. 01 of 2016 registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code. At the very outset, it is submitted that in this case, similarly situated co-accused, Sunil Jha @ Sunil Kumar Jha has already been allowed bail vide Cr. Misc. No. 14198 of 2016. Further, other co-accused, Prabhakar Chaudhary was also allowed bail and the petitioner is suffering in custody since 29.02.2016 and against the petitioner, there is no other material than as against coaccused, Sunil Jha @ Sunil Kumar Jha. The petitioner has got no criminal antecedent.

In the facts and circumstances stated above, the petitioner above named is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Sakatpur P.S. Case No. 01 of 2016, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
