JUSTICE ARUN KUMAR ORAL ORDER 08-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Rajiganj PS Case No. 460 of 2017 registered under Sections 413, 414 and 34 of the IPC.

Submission is that the stolen motorcycle was not recovered from the possession of the petitioner rather the recovery was from one Suraj Kumar Sah; only material against the petitioner is that he had disclosed that he robbed the motorcycle along with the petitioner and except that there is no other material and the petitioner is in custody since 23.12.2017.

Having considered the said facts and circumstances, the petitioner, namely, Pankaj Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Araria in connection with Raniganj PS Case No. 460 of 2017. The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
