The petitioner is accused in connection with Brahampura P.S. Case No. 11 of 2016 registered under Sections 25(1-b)A/26 of the Arms Act.

The accusation is that petitioner was apprehended by the police having country made loaded pistol, who confessed about his indulging in the crime and also disclosing the name of his associates. On search, Rs.4,700/- was recovered from the beneath the bed of his house.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion and also the petitioner has no concerned with the

Patna High Court Cr.Misc. No.17809 of 2016 (2) dt.02-05-2016 recovered materials. It is further submitted that petitioner is accused in one another case, in which, he is on bail and he is in custody since 12.01.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Brahampura P.S. Case No. 11 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
