JUSTICE ARUN KUMAR ORAL ORDER 08-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kurtha PS Case No. 53 of 2017 registered under Sections 366A/34 of the IPC and Section 4 of the POCSO Act.

Submission is that it is a case of elopement, the girl is major, both are now married and living together and the Court has also assessed age of the girl 18 years while recording her statement under Section 164 Cr.P.C.

Having considered the said facts and circumstances, the petitioner, namely, Om Prakash Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge lst, Jehanabad in connection with Kurtha PS Case No. 53 of 2017.
