JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Hilsa P.S.Case No. 649 of 2015 registered under Section 395 of the Indian Penal Code.
It would appear from the FIR that the petitioner is not named in the FIR by the informant. On the next day, after lodging the case, Balmiki Prasad and Rajiv Kumar, father and brother of the informant have disclosed the name of this petitioner being one of the dacoits involved in the present case. Thereafter the petitioner was apprehended by the police and put on T.I. parade. Further submission is that, in fact, the village of the petitioner and the village of the informant are adjacent and the petitioner is
Patna High Court Cr.Misc. No.17666 of 2016 (2) dt.28-04-2016 2/2 known to him. Further submission is that the petitioner has been made accused in eleven other cases and due to that reason, in the present case, the name of the petitioner has also been shown by the police.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Hilsa, in connection with Hilsa P.S.Case No. 649 of 2015.
