This is an application for grant of anticipatory bail in Barsoi P.S. Case No. 40 of 2019, disclosing offence under Section 409 of the Indian Penal Code.

The petitioner, at the relevant point of time, was working as Incharge Headmaster of an upgraded Middle School, Dhachna in the district of Katihar.

Allegedly, he misappropriated a sum of Rs. 18,67,000/- which was made available to him for construction of School building. Learned counsel appearing on behalf of the petitioner has submitted that he is ready to complete construction of School building in question.

Considering the serious nature of allegation against

Patna High Court CR. MISC. No.45607 of 2019(3) dt.01-10-2019 2/2 the petitioner, who misappropriated the public money in his capacity as Headmaster of the School that too, for the purpose of construction of School building, I am not inclined to grant him the privilege of anticipatory bail.

This application is rejected.

However, the petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
