The petitioner seeks regular bail in connection with Gogari P.S. Case No. 135 of 2021 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 28.03.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 25 litres of country-made liquor from two jars kept on a motorcycle.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.58935 of 2021(2) dt.07-01-2022 2/2 motorcycle does not belong to him and he has been falsely implicated in the present case at the behest of his enemies. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 28.03.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Gogari P.S. Case No. 135 of 2021.
