The petitioners seek pre-arrest bail in connection with Halsi (Ramgadh Chowk) P.S.Case No. 74 of 2017 registered under Sections 307, 324, 504, 34 of the Indian Penal Code and Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act. Regard being had to the specific allegation against the petitioner no.1 Raj Kishore Singh @ Bajjar Singh that he fired from rifle causing injury to two persons, I am not inclined to grant him pre-arrest bail. Accordingly, his application for grant of prearrest bal is rejected. So far as petitioner no.2 Rama Yadav is concerned, save and except the fact that he was also present at the place of
Patna High Court Cr.Misc. No.826 of 2018 (2) dt.15-01-2018 2/2 occurrence, there is no specific allegation against him and it is stated in para 3 of the petition that he is a man of clean antecedent, in the event of arrest or surrender before the court below within four weeks from today, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Lakhisarai in connection with Halsi (Ramgadh Chowk) P.S.Case No. 74 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
