JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 120B of the Indian Penal Code.

Petitioner is in jail custody since 12.08.2015 on the accusation that one country made pistol and nine cartridges were recovered from possession of the petitioner when he along with others had assembled to make preparation for committing dacoity. Contention on behalf of the petitioner is that for recovery of firearm and cartridges, a separate case has been registered and so far as present case is concerned, petitioner is in jail custody since long and the investigation of this case has

Patna High Court Cr.Misc. No.18579 of 2016 (2) dt.03-05-2016 2/2 already been completed. It is also pointed out that except the present case as well as above stated case of Arms Act, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Samastipur in connection with Sessions Trial No. 27 of 2016 arising out of Khanpur P.S.
