The petitioner seeks bail in connection with Sessions Trial No.51 of 2016, arising out of Mansahi P.S. Case No.76 of 2003, registered under Sections 304(B) and 120 of the Indian Penal Code.

The accusation is of killing the deceased, the daughter of the informant, by her husband and in-laws for non fulfillment of the dowry demand.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is the mother-in-law of the deceased and has falsely been implicated in this case. Further submission is

Patna High Court Cr.Misc. No.19518 of 2016 (2) dt.05-05-2016 2/2 that the co-accused Awadhesh Kewat, the husband of the deceased, has already been acquitted vide Judgment dated 13.01.2009 passed in Sessions Trial No.204 of 2003 by the court of Additional Sessions Judge, Fast Track Court-II, Katihar. The petitioner is in custody since 31.10.2015 and charge has already been framed against the petitioner on 20.02.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV, Katihar, in connection with Sessions Trial No.51 of 2016, arising out of Mansahi P.S. Case No.76 of 2003.
