JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-05-2022 Heard learned advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Mairwa P.S. Case No. 16 of 2019 dated 18.01.2019 instituted for the offences under Sections 272, 273, 308/34 of the Indian Penal Code and Section 30(a), 38(1), 41(1) of the Bihar Prohibition and Excise Act.

4557.600 litres of liquor is said to have been recovered from the vehicle.

The petitioner is alleged to be the person who was escorting the vehicle and was perhaps making the way clear for the vehicle to reach its destination. However, he is in custody since 10.08.2021.

It has been urged on behalf of the petitioner that he

Considering the nature of accusation against the petitioner and the period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge (Excise), Siwan in connection with Mairwa P.S. Case No. 16 of 2019.
