JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Narpatganj P.S. Case No. 326 of 2017 instituted for the offence under Sections-307, 379, 325, & other minor Sections of the Indian Penal Code. There is specific allegation against these petitioners of assaulting the brother of the informant with iron rod on the head causing serious injury.

The case diary has been received wherein the injury report is available, which shows that brother of the informant received two injuries, which were found to be grievous in nature. Considering the facts and circumstances, this court is not

Patna High Court Cr.Misc. No.54599 of 2017 (3) dt.18-12-2017 2/2 inclined to grant anticipatory bail to petitioners. Accordingly, prayer for anticipatory bail stands rejected.

The petitioners are directed to surrender in the court below and seek regular bail which will be considered and disposed of preferably, if possible on the same day on its own merit without being prejudiced by this order.
