The petitioner is accused in connection with Khanpur P.S. Case No. 62 of 2015, registered under Section 414 of the Indian Penal Code and 25(1-b) a, 26 and 35 of Arms Act. The petitioner and other others were apprehended by the Police and on search the petitioner was found in possession of one country made pistol and nine live cartridges. Learned counsel for the petitioner submits that petitioner and others were apprehended by the Police mere on suspicion showing the recovery of the country made pistol and nine live cartridges on which Khanpur P.S. Case No. 63 of 2015 was also instituted under Section 399, 402, 120(B) of the Indian
Patna High Court Cr.Misc. No.19563 of 2016 (2) dt.09-05-2016 2/2 Penal Code, except the suspicion there is nothing against the petitioner to show his involvement in the present case. The petitioner is in custody since 23.04.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Samastipur in connection with Khanpur P.S. Case No. 62 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
