JUSTICE ARUN KUMAR ORAL ORDER 09-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Harsidhi PS Case No. 399 of 2017 registered under Sections 413 and 414 of the IPC. Learned Counsel for the petitioner submits that the stolen motorcycle was recovered from the possession of Ajay Sahni who disclosed that it was stolen by one Pankaj Yadav and other motorcycles were recovered from other co-accused and not from the petitioner, only it is said that he was also member of the gang and besides that there is no other material against him, he is in custody since 14.10.2017 and charge-sheet has been submitted.

Having considered the said facts and circumstances, the petitioner, namely, Rajan Sahani is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM East Champaran at Motihari in connection with Harsidhi PS Case No. 399 of 2017.
