====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with S.T. No. 407 of 2021 arising out of Dariyapur P.S. Case No. 256 of 2021 instituted for the offences under Sections 399, 402 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.06.2021, charge-sheet has been submitted and has antecedent of one case as stated in the supplementary affidavit.

Allegation is of recovery of one country made loaded Katta with six live cartridges from the possession of the

Patna High Court CR. MISC. No.59074 of 2021(2) dt.09-03-2022 2/2 petitioner and one country made Katta with four live cartridges from Raju Nut.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and nothing was recovered from his possession.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Saran at Chapra in connection with S.T. No. 407 of 2021 arising out of Dariyapur P.S. Case No. 256 of 2021, with condition that one of the bailors shall the father (Ladu Ray) of the petitioner and further if the petitioner is implicated in a case of similar nature and the same comes to the notice of the learned court below, the learned court below shall forthwith cancel the bail bond of the petitioner.
