The petitioner apprehends her arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. Later on, sections 386, 307, 120(B) of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, all the accused persons including petitioner fraudulently sold the land of informant to one Vikash Kumar. On 12.01.2022 all the accused persons came at the land of informant, abused, assaulted the informant and also demanded money. When informant protested, the accused persons started firing, snatched cash of Rs. 10,000/- and gold chain from possession of the informant.

It is submitted that there is general and omnibus

Patna High Court CR. MISC. No.48827 of 2022(2) dt.13-12-2022 2/2 allegation. Admittedly, there is land dispute between the parties for which Title Suit No. 12 of 2002 is pending before the court of Sub-Judge Ist, Patna City. Though, there is allegation of assault, but there is no injury report on the record. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, Patna in connection with Fatuha P.S. Case No. 42 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
