JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is in custody since 20.10.2014 in Kahalgaon P.S. Case No.483/14 for the offence under Sections 379 and 411 of the I.P.C.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that when the informant on 19.10.2014/20.10.2014 at about 2 O' clock in the night woke up he found his cows missing. In course of search he found one cow and when he reached near Chathariyapir he saw six miscreants loading his cow on a Tata- Magic bearing No.J.H. 17E 5197. In the meantime patrolling police party arrived there and all miscreants were caught by them two of them were identified by the informant and rest four persons were known to
Patna High Court Cr.Misc. No.25402 of 2015 (2) dt.23-07-2015 2/2 the people of vicinity.
On behalf of the petitioner it has been submitted that he is in custody since 20.10.2014 and charge sheet has been submitted in this case. It is further submitted that other co-accused have already been granted bail vide Annexure-2 series. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Anwar Shamim, J.M.,1st Class, Bhagalpur, in Kahalgaon P.S.
