This is an application for regular bail in connection with Tajpur P.S. Case No. 336 of 2017 registered for the offences punishable under Sections 147, 148, 149, 307, 323, 365, 363 and 120B of the Indian Penal Code.
Informant is the mother of victim girl who in her fardbeyan has stated that 10 to 15 miscreants came to her house and assaulted them and took her daughter with them. In the meantime, police was informed and two of the accused persons were apprehended by police and villagers on the spot. Both of them are petitioners here. The girl has been recovered and she has stated that she has love affair with Hemant Kumar and she
Patna High Court Cr.Misc. No.13915 of 2018(3) dt.06-04-2018 2/2 had gone with him voluntarily. In her statement under Section 164 Cr. P.C. she has stated that said Hemant Kumar had abducted her and forcibly raped her. However, there is no allegation against petitioner and she has not alleged anything adverse against petitioners.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Ist Addl. Sessions Judge and Special Judge POCSO in connection with Tajpur P. S. Case No. 336 of 2017.
