Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 419 and 420 of the Indian Penal Code, registered in connection with Konch P.S.Case No. 302 of 2021.

As per allegation, 498 bags of urea were recovered from a truck and pick up van.

The learned counsel for the petitioner has submitted that he is the owner of pick-up van wherefrom 50 bags of urea

Patna High Court CR. MISC. No.48690 of 2022(2) dt.11-01-2023 2/2 was recovered. He has submitted further that he was not aware of the consignment loaded on the truck, as he had assigned the vehicle to his driver Md. Rizwan Quraisi, who has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc. No. 3470 of 2022.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Gaya in connection with Konch P.S.Case No. 302 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
