JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 02.05.2016 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners seek bail in a case registered under section 304B/34 of the Indian Penal Code.

Petitioner no.1 is father-in-law whereas petitioner no.2 is brother-in-law of the deceased. Marriage of the deceased had taken place on 31.5.2015 but within four months of her marriage, she died in other than normal circumstance.

There is allegation of illegal demand and torture but submission on behalf of the petitioners is that petitioners are separate from the husband of the deceased and, as a matter of fact, they do not have any concern with the affair of the husband of the deceased. It is further submitted that, as a matter of fact, deceased committed suicide due to petty family feud.

Patna High Court Cr.Misc. No.18606 of 2016 (2) dt.02-05-2016 Petitioners are in jail custody since 8.1.2016 and investigation against them has already been completed and it appears that further detention of the petitioners in jail custody for the purpose of interrogation is not required.

Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri A.K. Mall, Judicial Magistrate, Ist Class, Araria/ concerned court in Sikty (Bardaha) P.S. Case no. 86/2015.
