The petitioner is in custody since 26.11.2014 in connection with Dalsingsarai P.S. Case No. 544 of 2014 registered for the offences punishable under Sections 341, 323, 504, 384, 324, 307 of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner submits that though there is allegation against the petitioner but the injury report only goes to show the fire arm injury. It is submitted that there was no repeation so as to make out a clear case under Section 307 of the I.P.C.
Considering the nature of allegation and the period of custody and also the fact that the F.I.R. of the present case was

No.11578 of 2015 (2) dt.25-05-2015 2 / 2 recorded on 23.11.2014 at 4.45 P.M. whereas requisition for conducting medical examination was sent on 22.11.2014 itself, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Dalsingsarai, Samastipur, in connection with Dalsingsarai P.S. Case No. 544 of 2014.
