Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner seeks bail in a case registered for the offence under Sections-363, 366A, 376 of the Indian Penal Code and Section- 4 of the POCSO Act as well as Section-9/10 of Child Marriage Restraint Act.

The prosecution allegation, in short, is that the minor daughter of the informant was kidnapped by accused persons for the purpose of marriage.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no

Patna High Court CR. MISC. No.49200 of 2022(2) dt.21-12-2022 2/2 allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 27-04-2022. Charge sheet has already been submitted in the present case. The victim has been recovered and her statement under Section-164 of the Cr. P.C. was recorded. In her statement recorded under Section164 of the Cr.P.C., she has stated that she left house out of her own sweet will and she has performed marriage with the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.IR.

Considering the aforesaid facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each of the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 113 of 2022.
