JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-06-2016 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Muffasil P.S. Case No. 258 of 2015, registered under Section 302 & 201 of the Indian Penal Code.

The accusation is that on 18.07.2015 Sonu Kumar, aged about 15 years, son of the informant, was accompanied with the petitioner for preparation of sweet, but he did not return to his house. On query, informant came to know that on 19.07.2015 to her sister Rekha Devi of village Abgila that Sonu was seen with Chintu (Petitioner) and petitioner was asked to leave the Sonu at his house, but Sonu did not return to his house. On 20.07.2015, the dead body of son of informant was found lying on the railway track. The informant raised suspicion

Patna High Court Cr.Misc. No.19154 of 2016 (3) dt.29-06-2016 2/2 against one Nagendra Pathak, who has earlier given threatening to kill his son.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that no motive has been disclosed about committing murder of the deceased and mere on suspicion, the petitioner has been falsely implicated in this case. The petitioner having no criminal antecedent is in custody since 03.11.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 258 of 2015.
