Since both these bail applications arise out of one and the same P.S. case, they have been heard together and are being disposed of by this common order.

Petitioners seek bail in a case registered for the offences punishable under sections 420, 467 and other allied sections of the Indian Penal Code.

Patna High Court Cr.Misc. No.26041 of 2015 (3) dt.15-09-2015 The informant alleged that the petitioners have illegally got their names mutated with regard to the land standing in the name of the informant.

It is submitted that petitioner Rupesh Kumar Mishra purchased land from Bhola Nath Mishra. Bhola Nath Mishra had purchased the same from one Madan Mohan Mishra but the name of Bhola Nath Mishra was not mutated. After 1961 the land in question has wrongly been recorded in the name of father of the informant though there is no record to show that the aforesaid land ever stood in the name of father of the informant. The petitioners are in jail since 09.03.2015 and 04.02.2015 respectively.

Considering the facts aforesaid, petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia in connection with Bihpur (Bhawanipur) P.S. Case No. 410 of 2014.
