Petitioner is apprehending his arrest in connection with Habibpur P.S. Case No.144 of 2021, registered for the offence punishable u/s 341, 323, 324, 504, 506, 307, 34 of the IPC. 3.
Allegedly, the petitioner is said to have given a knife blow in the stomach of the informant and when his brother came to save him, then the petitioner gave a knife blow in the stomach of informant's brother.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case due to ulterior motive. No such occurrence in the manner as alleged has ever
Patna High Court CR. MISC. No.51206 of 2023(4) dt.11-12-2023 2/2 taken place. There is general and omnibus allegation against the petitioner. Petitioner has one criminal antecedent. 5.
Learned APP for the State opposed the prayer for bail by submitting that there is specific allegation against the petitioner to assault the informant and his brother and it transpires from the impugned order that the injury report has supported the prosecution case.

Considering the aforesaid facts and circumstances and the nature of injury, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
