JUSTICE SANJAY PRIYA ORAL ORDER 09-02-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Taraiyan P.S. Case No. 151 of 2015 instituted for the offence under Sections 304(B),34 of the IPC.

This petitioner is the husband of the deceased. There is allegation against this petitioner that he used to torture the granddaughter of the informant for demand of dowry of Rs. 1,00,000/-. It is further alleged that his grand-daughter became pregnant and on 31.07.2015, the grand-son of the informant went to bring her sister (the deceased) to Naihar. The family members of petitioner did not allow her to go Naihar. The informant got information on 01.08.2015 that petitioner and other accused persons have killed her grand-daughter by hanging.

No.1797 of 2018 (3) dt.09-02-2018 2/2 Learned counsel for the petitioner has submitted that the informant has later on filed a compromise petition in the court below stating that his grand-daughter has committed suicide. The case diary has been received, wherein, the doctor has opined the cause of death due to asphyxia. As per the written report, it appears that deceased died unnatural death in her sasural. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law and disposed off without being prejudiced by this order. (Sanjay Priya, J) khushbu/- U T
