JUSTICE BIRENDRA KUMAR ORAL ORDER 09-03-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 414,420/34 of the Indian Penal Code.

From possession of the petitioners, a stolen motorcycle was recovered. The petitioners are in custody since 23.12.2017.

Submission of the petitioners is that they have got no criminal antecedent. Investigation is already complete and the recovery is not from conscious possession of the petitioners.

Considering the entire facts aforesaid, let the petitioners, above named, be released on bail after

Patna High Court Cr.Misc. No.13615 of 2018 (2) dt.09-03-2018 completion of six months of custody or after framing of the charge whichever is earlier on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jokihat Police Station Case No.402 of 2017, subject to the condition that the petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
