JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-04-2016 Heard learned counsels for the petitioner and the State. The petitioner, being the father-in-law of the deceased, is languishing in jail since 23.12.2015 in a case registered for the offences punishable under Sections 498A and 304 (B) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The prosecution case, in short, is that the daughter of the informant was married to the son of the petitioner on 28.11.2013. Thereafter, a demand of motor-cycle and golden chain was made and on account of non-fulfilment of the same, the victim was tortured and killed.
It is submitted by learned counsel for the petitioner that there is a general and omnibus allegation against the petitioner and the allegation of demand of dowry and assault is against the
Patna High Court Cr.Misc. No.17877 of 2016 (2) dt.25-04-2016 husband of the deceased victim girl, who is in custody. Considering the aforesaid facts and the nature of allegation against the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri P. Kumar, Additional Chief Judicial Magistrate, XIII, Bhagalpur in connection with Budhuchak P.S. Case No.30 of 2015. (Dinesh Kumar Singh, J) V.P.Sinha/- U T
