The petitioners seek bail in anticipation of their arrest in connection with Hajipur Sadar P. S. Case No. 110 of 2020, dated 14.02.2020, instituted for the offences under Sections 323, 341, 307, 354, 504 and

Patna High Court CR. MISC. No.3932 of 2021(5) dt.02-11-2021 2/3 506 of the Indian Penal Code and Section 3 of the Prevention of Witch (Daain) Practices Act, 1999. The accusation in the F.I.R. is of the petitioners having assaulted and misbehaved with the female members of the house on the charge of their practicing witchcraft. The injuries suffered by the victim are all stated to be simple in nature except one about which opinion has been reserved.

That injury is attributable to another accused person and not the petitioners.

Considering this aspect of the matter and the possibility of the false implication of the petitioners, case-diary was called for and the petitioners were granted provisional bail.

The case-diary has since been received. There is nothing in the case-diary to indicate anything otherwise.

For the reasons afore-stated, the provisional bail granted to the petitioners vide order 04.08.2021 is,

Patna High Court CR. MISC. No.3932 of 2021(5) dt.02-11-2021 3/3 hereby, confirmed.

The application stands allowed.
