JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 4.4.2015 in Bhagwan Bazar P.S. Case No.64/14 for the offence under Sections 366A of the I.P.C. and later on Section 376 of the I.P.C. was added.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that the accusation against the petitioner along with other co-accused is of enticing the grand daughter of the informant, Anjali Kumari, away with intent to marriage or commit rape on 13.9.2013 as the petitioner used to come to the father of the victim girl to get training of mechanic and since the date of occurrence the petitioner was also not seen there. Patna High Court Cr.Misc. No.27128 of 2015 (2) dt.29-07-2015 2/2 traced out. Then the informant asked whereabout of the petitioner from his parents upon which they replied that he had gone to Hyderabad for appearing at the examination.

It has been submitted on behalf of the petitioner that he is in custody since 4.4.2015. Charge sheet has been submitted in this case. The victim herself in her 164 Cr.P.C. statement has made allegation against the mother of the petitioner and she has, at the same time, admitted the marriage with the petitioner. It further appears that a false case against the petitioner and his mother. It is submitted on behalf of the State that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Chapra, Saran, in Bhagwan Bazar P.S. Case no.64/14.
