The petitioner seeks bail in Maharajganj P.S. Case No. 190 of 2017 registered for the offence punishable under Sections 379 and 511 of the Indian Penal Code. Informant in his complaint has stated that on 18.10.2017, he proceeded with his motorcycle at about 10:00 am from his house and reached State Bank Maharajganj at about 11:00 am and after locking his motorcycle, he went into the bank for withdrawal of amount and was also keeping an eye over his motorcycle. At about 11:10 am one boy opened the lock of motorcycle and tried to start the motorcycle and he caught him red handed on the spot and thereafter he was handed over to the police.

Patna High Court Cr.Misc. No.14423 of 2018(3) dt.06-04-2018 2/2 It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case. No motorcycle has been recovered from his possession and is in custody since 19.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Siwan in connection with Maharajganj P.S. Case No. 190 of 2017.
