JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-06-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Uchakagaon P.S. Case No. 143 of 2014 registered for the offence punishable under Sections 302/34 of the Indian Penal Code. Allegedly, the petitioner assaulted the husband of the informant with hammer on his head causing his death. Submission is of false implication and that the prosecution story is not probable and reliable, co-accused Piyush Ram has already been allowed bail and as such the petitioner deserves sympathetic consideration to which the learned APP opposes the prayer of bail by submitting that the petitioner is the assailant.

In the facts and circumstances stated above, considering the allegation attributed against the petitioner, at

Patna High Court Cr.Misc. No.17767 of 2016 (3) dt.27-06-2016 present, I am not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected in connection with Uchakagaon P.S. Case No. 143 of 2014 pending in the Court of learned 6th Addl. Session Judge, Gopalganj.

Let the trial be expedited and concluded as early as possible.
