JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Bahera PS case no. 203 of 2017 registered for the offences punishable under Sections 448, 341, 323, 380, 504/34 of Indian Penal Code.

The allegations against the accused persons is regarding forcibly taking the thumb impression of the informant on the stamp paper and upon the informant side objecting to the same, the accused persons assaulted them resulting in injury to the informant side.

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case as no

Patna High Court Cr.Misc. No.63012 of 2017 (2) dt.11-01-2018 2/2 such incident as alleged, has ever taken place and infact, the coaccused persons have already been granted bail by the learned lower court. It is further submitted that the petitioners have clean antecedents.

Having regard to the facts and circumstances of the case, the abovenamed petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Bahera PS case no. 203 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
