Mr.Kanhaiya Kishore (App 100) ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 30-07-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence under Sections 25(1-b)a,26(i)(ii),35 of the Arms Act and Sections 30(a),32(b),38(a) of the Bihar Prohibition & Excise Amendment Act, 2018.

Co-accused Golu Kumar @ Vishal Kumar was apprehended along with fire-arms and other weapons of cutting as well as foreign liquor was recovered from his possession. He discloses the name of two persons including the petitioner as business partner. Petitioner has got no criminal antecedent. Investigation of the case is already complete. Petitioner is in custody since 23.04.2019.

Considering the aforesaid fact, let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Lakhisarai P.S.

Patna High Court CR. MISC. No.46747 of 2019(2) dt.30-07-2019 2/2 Case No.712 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below having immovable property in his name.
