JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18.04.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Near about ten lacs counterfeit notes are said to have been recovered from conscious possession of the petitioner for which the petitioner is in jail custody since 10.9.2015.

Trial court has reported that up till now, only three prosecution witnesses have been examined. Trial court has further reported that the informant and one Sanjay Kumar Singh, SHO, Bairiya have been left to be examined. Furthermore, trial court has reported that in spite of issuance of letters to the concerned police officials, witnesses are not

Considering the aforesaid facts and circumstances as well as nature of the allegation levelled against the petitioner, I am not inclined to release the petitioner on bail and, again, her prayer for bail in connection with Session trial no. 96/2016 arising out of Majhaulia P.S. Case no. 442/2015 pending in the court of Addl. Sessions Judge VI, West Champaran, Bettiah stands rejected.

Let a copy of this order be sent to Superintendent of Police, West Champaran, Bettiah with direction to him to ensure the presence of the informant Harish Chandra Thakur, the then SHO, Majhaulia and Sanjay Kumar Singh, the then SHO, Bairiya before the concerned court within three weeks from the date of receipt/production of a copy of this order and trial court is directed to conclude the trial of the petitioner within four months from the date of receipt/production of a copy of this order and if trial of the petitioner is not concluded within the above stated period of four months due to laches of the prosecution, petitioner may renew his payer for bail before the trial court itself. shahid (Hemant Kumar Srivastava,J) U T
