Mr. Narsingh Tanti ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-06-2021 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State, through Video Conferencing.

The petitioner seeks regular bail in connection with Mufassil Police Station Case No. 53 of 2020, registered for the offence punishable under Section 392/34 of the Indian Penal Code.

The prosecution story, as per the First Information Report, is that while the informant was driving the tempo, he was intercepted by two unknown persons, who stopped the tempo, assaulted the informant, fled away with the tempo and also snatched the mobile of the informant.

Learned Counsel for the petitioner submits that the petitioner has been dragged in this case on the basis of the

No.4092 of 2021(3) dt.23-06-2021 2/2 confessional statement of co-accused, on whose indication, the tempo was recovered by the police and the petitioner was also arrested and the looted mobile was recovered from the possession of the petitioner. He further submits that the petitioner has got no criminal antecedent of similar nature and he is in custody since 14.02.2020. He further submits that due to COVID-19 pandemic, the trial of the case is not likely to be concluded in near future.

Having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 14.02.2020, having no criminal antecedent of similar nature, I am inclined to grant regular bail to the petitioner.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail, upon furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Mufassil Police Station Case No. 53 of 2020.
