2. In the present case, the petitioner seeks bail in connection with Beur P.S. Case No. 125 of 2025, registered for the offences under Section 309(4) of the B.N.S.

3. As per the prosecution case, the vehicle of the informant was taken on hire by one Nitish Kumar for transportation of some goods. While going to his destination, the vehicle of the informant was snatched by three persons who also took away Rs. 1500/- and fled away with the vehicle. The name of the petitioner transpired during investigation for being involved in the said occurrence.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been

The petitioner has been named in the case on the basis of confessional statement of co-accused Suraj Kumar but the said person is having enmity with the petitioner and for this reason he has named him in this case. Nothing incriminating has been recovered from person or possession of this petitioner who is having no criminal antecedent. Learned counsel further submits that similarly placed co-accused Jitendra Kumar and Bholu Kumar have been granted bail vide orders dated 09.07.2025 and 18.07.2025 passed in Cr. Misc. No. 41129 of 2025 and 43742 of 2025, respectively by different Coordinate Benches of this Court. The petitioner is in custody since 30.03.2025 and charge sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that the name of the petitioner transpired during investigation for being involved in the alleged occurrence.

6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the vague nature of allegation against the petitioner and also considering no recovery from the petitioner, his period of custody and submission of charge sheet against him, the

No.47365 of 2025(2) dt.30-07-2025 3/3 petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Patna/concerned court, in connection with Beur P.S. Case No. 125 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
