JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in a case registered for the offences punishable under sections 436 and 388 of the Indian Penal Code.
The informant has alleged in the F.I.R. that on 4.3.2015 in the night he got a rumour that a fire took place in the house of muslim and the villagers are naming some Hindus for that. When the informant reached the village, he was informed by the Chowkidar that the petitioner himself put fire to the hut of his maternal uncle Sirajul asking him to leave the house. It is alleged that it was Virendra Paswan who did that thereby trying to break the communal harmony of the said village.
Patna High Court Cr.Misc. No.26525 of 2015 (2) dt.27-07-2015 On behalf of the petitioner it is submitted that the petitioner is in custody since 04.03.2015. Charge-sheet has been submitted in the case. The petitioner has no criminal antecedent. It is further submitted that the petitioner has been implicated in the present case due to land dispute going on and due to village politics.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the facts aforesaid, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Paroo P.S.
