The petitioner is languishing in custody since 27.01.2014 in a case registered for the offences punishable under Section 302 of the Indian Penal Code.

The prosecution case is that the husband of the informant was working in a hotel but he was found lying with injury on the head and he was taken to Sadar Hospital, Katihar and from there he was referred to PMCH, Patna, but on way to Patna he died. Suspicion was raised against the petitioner being an employee of the said hotel.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled

Patna High Court Cr.Misc. No.25634 of 2015 (2) dt.23-07-2015 2/2 and the investigation has already concluded.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Katihar in connection with Sessions Trial No. 188 of 2014 arising out of Katihar Town P.S.
