This writ petition has been filed by the petitioner for a direction to the respondent authorities to fix the pension and gratuity and other retiral benefits and pay the same with arrears along with interest.
Petitioner was appointed as Assistant Teacher in
Patna High Court CWJC No.13925 of 2019 dt.17-06-2020 2/3 Rajkiya Prathmik Vidyalaya, Khairwa Tola Chhaudadno, East Champaran on 9.4.1986 and retired as Head mistress in Rajkiya Prathmik Vidayalaya, Jai Prakash Nagar, Motihari, East Champaran on 31.8.2018 and after her retirement, she received amount of GIC, PF and Earned Leave, however, other retiral benefits, such as pension and gratuity were not paid to her. Counter affidavit has been filed on behalf of respondent no.
4, District Education Officer, East Champaran, in which it has been stated that the grievances of the petitioner has been redressed and sanction for pension and gratuity was made and sent to the office of Accountant General and thereafter authority slip in favour of petitioner for payment of pension and gratuity was issued by the Accountant General, however, since petitioner had not submitted the utility voucher for the amount of Rs.49,000/- which was withdrawn by the petitioner as such, said amount has been withheld and will be paid as soon as petitioner submits the utility voucher with respect to amount withdrawn by her.
The writ petition is disposed of with a direction to petitioner to submit the utility vouchers with respect to Rs.49,000/- withdrawn by her and thereafter the District Education Officer, East Champaran, respondent no.4 shall
Patna High Court CWJC No.13925 of 2019 dt.17-06-2020 3/3 release the withheld amount in favour of petitioner within 15 days thereafter.
