Accusation against the petitioner is that he was present at the place of occurrence having pistol in his hand but according to the prosecution case itself, not only petitioner but two other persons were also carrying pistol in their hands at the time of alleged occurrence and it is submitted on behalf of the petitioner that only one fire arm injury has been found on the person of the deceased. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, Saharsa in Sour Bazar P.S. Case no. 47/2014.
