====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-03-2021 Heard Mr. Alok Kumar Singh, learned counsel for the petitioner and Md. Arif, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Chousa P.S. Case No. 9 of 2020 registered for the offences punishable under Sections 341, 384, 379, 504 and 506/34 of the Indian Penal Code 1860.
The allegation as per the First Information Report is that brother of the informant was intercepted by the petitioner and other co-accused persons and demanded extortion amount of Rs.50,000/- and snatched a sum of Rs.10,000/- from the pocket of brother of the informant.
Learned counsel for the petitioner submits that the petitioner has falsely bee implicated in this case due to village

No.4042 of 2021(2) dt.23-03-2021 2/3 politics inasmuch as the petitioner and informant are covillagers and the wife of the petitioner had contested and won the Panchayat election as a Pramukh. Learned counsel further submits that in the year 2011, the wife of the petitioner was elected as Pramukh of Chousa Block and at the behest of the then Police Station Incharge of Chousa P.S. and due to the political pressure, the petitioner was made accused in eight cases. Learned counsel also submits that the petitioner has falsely been implicated in the cases one after another and have been made accused in altogether 22 cases whereas the petitioner is a fish trader. Learned counsel next submits that the petitioner is in custody since 19.06.2020 and charge sheet has already been submitted in the matter.
Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 19.6.2020 and charge sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate,
Patna High Court CR. MISC. No.4042 of 2021(2) dt.23-03-2021 3/3 Udakishunganj, Distt. Madhepura, in connection with Chousa P.S. Case No. 9 of 2020.
It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
