Petitioner seeks bail in a case registered under sections 376, 506 of the Indian Penal Code. Prosecution case is that on 09.04.2015 at about 7 A.M. after entering into the house of her father the petitioner raped the minor daughter of the informant aged about 11 years when she was alone in the house and also threatened to kill if she will raise hulla.

On behalf of the petitioner it is submitted that petitioner has not criminal antecedent. Annexure-2 is the medical report of the victim which indicates that no rape has been committed upon the victim. It is submitted that the petitioner has

On behalf of the State it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned A.D.J-I cum Special Judge, Katihar in Katihar Mahila P.S.
