Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code.

Petitioner is named in the first information report but according to the prosecution case itself, it was Tejan Mandal who went to call the deceased and after that the deceased in the company of the aforesaid Tejan Mandal and others including the petitioner took Tari at the shop of one Asha Devi @ Kari Devi. Furthermore, as per prosecution case, the aforesaid Tejan Mandal and Jamuna Mandal brought the deceased at his door.

The contention on behalf of the petitioner is that except the aforesaid material, there is nothing against the petitioner who does not have any criminal antecedent and is languishing in jail custody since 7.2.2016.

Patna High Court Cr.Misc.
