2. The petitioner seeks bail in connection with RPF Fatuha Post Case No. 03 of 2024 registered for the offence under Section 3 R.P. U.P. Act and 153 of the Railway Act.

3. As per the prosecution case, the petitioner has been caught with the alleged stolen articles.

4. The petitioner is in jail since 13.04.2024 and he claims to have clean antecedents.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of

No.52307 of 2024(2) dt.07-08-2024 2/2 the Railway Judicial Magistrate, Patna in connection with RPF Fatuha Post Case No. 03 of 2024, subject to the condition that the learned Railway Magistrate concerned, before accepting the bail bonds of the petitioner will verify that whether the petitioner has any criminal history or not. If the Magistrate finds that the petitioner has criminal history then the bail bonds of the petitioner shall not be accepted and if the Court below finds that the petitioner has no criminal history then his bail bonds shall be accepted.

7. In case, the petitioner is released on bail then he is directed to mark his attendance at Fatuha Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
