2. Petitioner seeks regular bail in connection with K. Hat (Madhubani) P.S. Case No. 589 of 2023 dated 14.05.2023 registered for the offences punishable under Sections 419, 420, 468/34 and 120B of the Indian Penal Code, Section 66(D) of the I.T. Act and Section 10 of Bihar Conduct of Examination Act.

3. The main submissions advanced by learned counsel for the petitioner are that in respect of the examination of recruitment of Excise Constable, the petitioner who appeared in the examination as a candidate was found using a bluetooth device at his examination center while his examination was going on and the same type of devices were also found from

No.49017 of 2023(2) dt.04-08-2023 2/2 other candidates namely Ravishankar Kumar and Pravin Kumar, out of them co-accused Ravishankar Kumar has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No. 46820/2023. Further submissions are that the petitioner has fair and clean antecedent and has been languishing in jail since 15.05.2023 and against him, the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's fair and clean antecedent, the nature of allegation against him, his custody period as well as completion of the investigation against him, this Court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with K. Hat (Madhubani) P.S. Case No. 589 of 2023.
