Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Mahila Police Station Case No. 10/2020 registered for the offences punishable under section 376D of the Indian Penal Code and section 6 of the POCSO Act.

As per the prosecution case, the petitioner called the victim from his mobile phone and when she came outside the house he along with other four accused persons took her to chaft house and committed rape on her.

Learned counsel for the petitioner submits that the petitioner and the victim were in love affair and petitioner has

Patna High Court CR. MISC. No.5098 of 2021(2) dt.06-04-2021 2/2 been falsely been implicated in this case under pressure of parents who were opposed to the affair. Medical report also does not support the allegation. Age of the victim has been assessed as 17/18 years.

Learned counsel for the State opposes the prayer for bail and submits that the victim in her 164 Cr.P.C, statement has supported the prosecution case and there is specific allegation of rape against the petitioner.

In view of the nature and gravity of allegation against the petitioner, his prayer for bail is refused. (Prabhat Kumar Singh, J) shashi/- U T
