The petitioners are in custody in a case registered under Sections 147, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.
The allegation against the petitioners and other coaccused is of forcibly cutting the crops of his (informant) land and assaulting his father. It is also alleged that accused persons took away Rs. 15,000/-, a mobile and silver chain. It has been submitted on behalf of the petitioners that the petitioners are in custody since 11.04.2015 and charge sheet has been submitted in this case. It is further submitted that it
Patna High Court Cr.Misc. No.26012 of 2015 (2) dt.24-07-2015 2/2 is a case and counter case. It is also submitted that the accused persons have also sustained injury in course of the occurrence and the same has not been explained by the prosecution. On behalf of the State, it has been submitted that the petitioner has no criminal antecedent.
Considering the facts aforesaid, let above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Udakishunganj in Udakishunganj P.S.Case No. 53/2015.
