JUSTICE BIRENDRA KUMAR ORAL ORDER 13-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offence punishable under Section 379 of the Indian Penal Code. Later on Section 414 of the Indian Penal Code was added. Though the FIR of the occurrence of theft of computer is against unknown. A CPU of the stolen computer system was recovered from the possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent and due to land dispute false case has been lodged. He is in custody since 30.12.2016.
Considering the entire facts aforesaid, let the
Patna High Court Cr.Misc. No.14468 of 2018 (2) dt.13-03-2018 P2/ petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Turkauliya (Raghunathpur) P.S. Case No.652 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
