Petitioner is apprehending his arrest in connection with Barabar Paryatak (Vishunganj O.P.) P.S. Case No. 28 of 2024, registered for the offence punishable u/s 30(a) of the Bihar Prohibition and Excise Act, 2022.

Recovery is of 25 litres of country made illicit liquor from a white coloured stick near a high voltage electric power plant on the rive bank and 1000 litres of java mahua from various places.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case. Nothing has been recovered from the conscious possession and house of the

Patna High Court CR. MISC. No.52988 of 2024(2) dt.31-08-2024 2/2 petitioner. The petitioner is indulged in this case on spice and implicated in this case due to village politics. The Petitioner has one criminal antecedent.

Learned APP for the State opposed the prayer for bail by submitting that the petitioner is the member of the syndicate involved in manufacturing illicit liquor. 6.

Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

This application is accordingly dismissed.
